Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Kindred ("the app"), you agree to these Terms of Service. If you do not agree, do not use the app.

2. Description of Service

Kindred is a personal relationship management application that helps you track and strengthen your personal and professional relationships. The app provides voice-to-text transcription, AI-powered insight extraction, contact management, reminders, and encrypted sync across devices.

3. Account Registration

• You must create an account to use Kindred.
• You must provide a valid email address.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must be at least 13 years old to use the app.

4. Your Data

Ownership

You own all data you create in Kindred, including contacts, voice recordings, notes, and any other content. We do not claim any ownership rights to your data.

Encryption

Your data is encrypted on your device before being synced to our servers. We cannot access or read your encrypted data. You are responsible for maintaining your recovery key. If you lose both your device and recovery key, your data cannot be recovered.

Backups

We recommend keeping your recovery key in a safe place. We are not responsible for data loss resulting from lost devices or lost recovery keys.

5. Acceptable Use

You agree not to:

• Use the app for any illegal purpose.
• Store content that infringes on third-party intellectual property rights.
• Attempt to circumvent the app's security measures.
• Reverse engineer or decompile the app.
• Use the app to store or process data subject to specific regulatory requirements, such as HIPAA or PCI-DSS, unless you independently ensure compliance.
• Share your account with others.

6. AI-Generated Content

• Kindred uses AI to transcribe voice notes and extract structured insights.
• AI-generated suggestions, including summaries, tasks, and proposed updates, are presented for your review.
• You control what is saved. The app never writes AI output to your data without your explicit approval.
• AI outputs may contain errors or inaccuracies. Always review before accepting.
• We do not guarantee the accuracy of AI-generated content.

7. Third-Party Services

Kindred relies on third-party services for certain functionality, including OpenAI for speech-to-text and AI processing, Supabase for authentication and encrypted data storage, and Firebase for push notification delivery.

These services have their own terms and privacy policies. Changes to these services may affect Kindred functionality.

8. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted service.
• The app is designed to work offline. Core functionality, including recording and local data management, works without internet.
• We may perform maintenance that temporarily limits functionality.
• We reserve the right to modify, suspend, or discontinue the service with reasonable notice.

9. Subscription and Pricing

• The current version of Kindred is free during the beta period.
• We may introduce paid plans in the future with advance notice.
• If paid plans are introduced, existing free features will be clearly communicated.

10. Limitation of Liability

To the maximum extent permitted by law:

• Kindred is provided "as is" without warranties of any kind.
• We are not liable for any indirect, incidental, special, or consequential damages.
• Our total liability shall not exceed the amount you paid for the app in the past 12 months.
• We are not responsible for data loss, except where caused by our gross negligence.

11. Indemnification

You agree to indemnify and hold harmless Kindred and its operators from any claims arising from your use of the app or violation of these terms.

12. Termination

• You may delete your account at any time through the app.
• We may terminate your account if you violate these terms.
• Upon termination, your encrypted data will be deleted from our servers within 30 days.
• Locally stored data on your device remains under your control.

13. Changes to Terms

We may update these terms from time to time. Material changes will be communicated through the app. Continued use after changes constitutes acceptance.

14. Governing Law

These terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles.
